MISSOURI COURT OF APPEALS FOR EASTERN DISTRICT TO HEAR CASES AT SOUTHEAST

As part of its ongoing educational outreach efforts, the Missouri Court of Appeals for the Eastern District will hear cases on its regular docket Nov. 2 on the campus of Southeast Missouri State University.

Cases are scheduled to be heard at 9 and 10:30 a.m. in Glenn Auditorium of Robert A. Dempster Hall. Four civil cases and one criminal appeal are expected to be heard. The hearings are open to the public.

This is the second consecutive year for the Missouri Court of Appeals for the Eastern District to hear cases on the Southeast campus. The Court was in session here last fall as well.

Four of the five cases to be heard on the Southeast campus are on appeal from Cape Girardeau County Circuit Court. One of the cases to be heard on Nov. 2 is on appeal from Ste. Genevieve County Circuit Court.

Appellate court judges expected to be on hand include Chief Judge Mary K. Hoff, George W. Draper III, Sherri B. Sullivan, Richard B. Teitelman and Lawrence E. Mooney. Fifteen judges serve on the full Missouri Court of Appeals for the Eastern District.

Cases on the docket Nov. 2 will be heard in panels of three judges. Hoff, Draper III and Sullivan are serving on the 9 a.m. panel. Hoff, Teitelman and Mooney are serving on the 10:30 a.m. panel. Both panels will take questions from the audience about the legal process at the conclusion of each session.

As a part of its outreach efforts, the court travels its circuit, occasionally conducting its business on university campuses in the Eastern District, to give students exposure to the judicial system and how the legal system operates and to make the Court accessible to the public. Dr. Peter Bergerson, chair of the Department of Political Science, says the Court travels its circuit so that "those people who have an interest in the Court will have a chance to see them work." He says Southeast Missouri State is the only campus without a law school where the Court has heard cases.

The Missouri Court of Appeals for the Eastern District is based in St. Louis.

The Department of Political Science in conjunction with Dr. Brian Smentkowski, assistant professor of political science who serves as the pre-law advisor at Southeast, Bergerson and Senior Judge Stan Grimm are responsible for bringing the hearings to campus.

Those attending will have the opportunity to see attorneys arguing their points of view based on briefs filed with the court prior to their appearance here Nov. 2. The Court of Appeals may uphold the lower court's decision, alter the lower court's decision, order a new trial or overturn the lower court's decision.
